Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the StorySip mobile application and website (collectively, the "Service"). The Service is owned and operated by 4L Digital Solutions, a company registered in the Netherlands (D-U-N-S® Number: 965586728), with its registered office at Brusselsestraat 8 D, 6211 PE Maastricht, the Netherlands ("Company", "we", "our", "us"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About the Service

StorySip is an audio entertainment platform that delivers classic literature and user-requested stories as short, narrated audio episodes powered by AI-generated voices and creative personas. The Service is available as an iOS application distributed through the Apple App Store and through our companion website at storysip.app.

2. Eligibility

• You must be at least 13 years of age to use the Service. If you are under 18, you must have parental or guardian consent.
• By using the Service, you represent and warrant that you meet these eligibility requirements.

3. User Accounts

• Certain features of the Service (such as progress tracking, content requests, and subscriptions) require you to create an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information when creating your account and to update it as necessary.
• We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

4. Subscriptions and Payments

• StorySip offers a free tier with limited content and a paid "StorySip Pro" subscription that unlocks full access to all content, features, and priority content requests.
• Subscriptions are billed through Apple's in-app purchase system (Apple IAP). All payment processing, billing, and refunds are handled by Apple Inc. in accordance with Apple's terms and policies.
• Subscription pricing is displayed in the app before purchase and may vary by region and currency.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription at any time via your Apple device's Settings → [Your Name] → Subscriptions.
• Refunds are subject to Apple's refund policy. 4L Digital Solutions does not process payments or refunds directly.
• We reserve the right to change subscription pricing. Any price changes will take effect at the start of the next billing cycle, and you will be notified in advance.

5. Intellectual Property

• The StorySip brand, application design, user interface, AI-generated audio content, narration scripts, persona designs, and all other original materials are the intellectual property of 4L Digital Solutions and are protected by applicable intellectual property laws.
• The underlying literary source material used for narration consists of public domain works. We do not claim copyright over the original public domain texts.
• You may not reproduce, redistribute, publicly display, publicly perform, modify, create derivative works from, or commercially exploit any content from StorySip without prior written permission from 4L Digital Solutions.
• The StorySip name, logo, and associated branding are trademarks of 4L Digital Solutions.

6. Content Requests

• Users may submit content requests (e.g., a book title combined with a preferred narrator persona) through the app.
• All content requests are reviewed at our sole discretion. Submitting a request does not guarantee that the requested content will be produced.
• We reserve the right to modify, reject, or deprioritize any content request for any reason, including but not limited to copyright concerns, feasibility, or editorial judgment.
• Content produced from user requests remains the intellectual property of 4L Digital Solutions.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or malicious purpose.
• Attempt to gain unauthorized access to our systems, servers, networks, or other users' accounts.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application.
• Use bots, scrapers, crawlers, or other automated tools to access, collect data from, or interact with the Service.
• Circumvent, disable, or interfere with subscription restrictions, security features, or payment mechanisms.
• Upload, transmit, or distribute any viruses, malware, or harmful code through the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

8. AI-Generated Content Disclaimer

StorySip uses artificial intelligence technologies to generate narration scripts and audio content. AI-generated content may contain creative liberties, condensed storylines, paraphrased passages, or unintended interpretations of the original source material. The content is provided for entertainment and educational purposes only and should not be considered a substitute for reading the original literary works. 4L Digital Solutions makes no warranties regarding the accuracy, completeness, or fidelity of AI-generated content to the original source material.

9. Third-Party Services

The Service integrates with third-party services including but not limited to Apple (in-app purchases, Sign in with Apple), RevenueCat (subscription management), Supabase (authentication and data storage), and Sentry (error reporting). Your use of these third-party services is subject to their respective terms of service and privacy policies. 4L Digital Solutions is not responsible for the practices or availability of third-party services.

10. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, 4L Digital Solutions, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service, including but not limited to loss of data, loss of profits, or business interruption. Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us (through Apple IAP) in the twelve (12) months preceding the event giving rise to the claim, or €50, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless 4L Digital Solutions, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

13. Termination

• We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.
• You may stop using the Service and delete your account at any time by contacting us.
• Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including but not limited to Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) shall survive.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app, on our website, or by sending an email to the address associated with your account. The "Effective Date" at the top of this page reflects the date of the latest revision. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts in Maastricht, the Netherlands. Nothing in these Terms shall affect your statutory rights as a consumer under applicable EU consumer protection law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 4L Digital Solutions regarding the use of the Service and supersede all prior agreements and understandings.
